You agree that by clicking “Join Now,” “Join InfoProfile,” “Sign Up,” or similar, registering, accessing, or using our services (described below), you are agreeing to enter into a legally binding contract with InfoProfile (even if you are using our Services on behalf of a company). If you do not agree to this contract (“Contract” or “User Agreement”), do not click “Join Now” (or similar), and do not access or otherwise use any of our Services. If you wish to terminate this contract, you can do so at any time by closing your account and no longer accessing or using our Services.
This Contract (including additional terms that may be provided by us when you engage with a feature of the Services) is the only agreement between us regarding the Services and supersedes all prior agreements for the Services.
You may not assign or transfer this Contract (or your membership or use of Services) to anyone without our consent. However, you agree that InfoProfile may assign this Contract to its affiliates or a party that buys it without your consent. There are no third-party beneficiaries to this Contract.
https://www.infoprofile.com (hereinafter referred to as “InfoProfile”) is a social platform that enables users to connect with their professional peers, colleagues, and other professionals. Users (hereinafter also referred to as “Members”) can share their professional and personal identities, engage with their peers, share insights, post, and view relevant content, and find business and career opportunities on the platform.
InfoProfile aims to provide the best services to its members, for which it has laid down the below-mentioned terms and conditions (hereinafter also referred to as “the terms”) that the Members are required to know and understand. The Members shall be bound by these terms immediately upon signing up at InfoProfile. The below-mentioned terms and conditions also bind a non-member or a casual internet visitor visiting InfoProfile.
i. This Contract governs your use of InfoProfile apps, InfoProfile services, InfoProfile communications, and such other services (hereinafter collectively referred to as “the Services” or “Service Platforms”) that InfoProfile shall notify from time to time which are owned and operated by Enso Webworks Private Limited company (hereinafter referred to as “the Owner,” “we,” “us,” or “our”).
ii. By accessing or using the Services, you agree to be bound by these terms, and if you are unable or unwilling to accept these Terms, you may close your account.
iii. You are entering into this Contract with _______________ and ______________ will be the fiduciary of your personal data provided to, or collected by or for, or processed in connection with our Services.
iv. When you register and join the Services, you become a “Member.” If you have chosen not to register for our Services, you may access certain features as a “Visitor.”
v. As a Visitor or Member of our Services, the collection, use, and sharing of your personal data are subject to our Privacy Policy and updates.
i. The Owner reserves and retains the right and prerogative to revise, amend, modify, alter, reword, update the privacy policy and this contract from time to time at its sole discretion and without prior notice. Any such changes, revisions, and amendments shall be published on the Service Platforms and come into force thereafter.
ii. It shall be your responsibility to periodically examine and acquaint yourself with the contents of these terms. If we make material changes to them, we will provide you with notice on the Service platforms or by other means to provide you with the opportunity to review the changes before they become effective. We agree that changes cannot be retroactive.
iii. If you object to any changes, you may close your account. Your continued use of our Services after we publish or send a notice about our changes to these terms means that you are consenting to the updated terms as of their effective date.
By joining and using the Services, you represent and warrant that:
i. You are at least 16 years old (“the Minimum Age”). However, if law requires that you must be older for InfoProfile to lawfully provide the Services to you without parental consent (including using your personal data), then the Minimum Age is such older age.
ii. You have a valid email address.
iii. You are not already restricted by InfoProfile from using the Services.
iv. Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 16.
Members of InfoProfile are the account holders. You thus agree to:
i. Create the account in your own name and provide accurate information.
ii. Use a strong password and keep it confidential.
iii. Follow the law and the list of Content Regulations (mentioned later in the terms).
iv. Be responsible for anything that happens through your account unless you close it or report misuse.
i. You are exclusively and totally responsible for all the content that you publish, upload, disseminate, or otherwise render accessible on the Service Platforms and hereby confer upon the Owner an irrevocable, royalty-free, globally applicable license, with no exclusivity, to employ, exhibit, replicate, modify, and circulate any user content, specifically for the purpose of the Services’ operation, enhancement, and amelioration.
ii. You explicitly assert and vouch that your User Content, in its entirety, is devoid of any violation or infringement upon the legal rights, including intellectual property rights, of any third party, and furthermore, your User Content is in strict accordance with the pertinent legal statutes and regulations.
iii. You agree that any content you share shall not be obscene, defamatory, or otherwise illegal.
iv. Your content shall abide by the Community Guidelines that InfoProfile may issue from time to time.
v. You agree to use the Services in a respectful and professional manner only.
vi. You agree not to engage in any conduct that is harmful, threatening, or harassing to other users or the public in general over the Services Platforms. However, if any claim, litigation, or demand arises against the Owner as a result of your/user content, you commit to indemnify, defend, and safeguard the Owner against any ensuing liability, losses, expenses, and damages, including attorney fees, which might be incurred.
vii. You agree not to engage in prohibited and illegal activities such as impersonating any person or entity, unauthorized commercial activities, spamming, hacking, phishing, or attempting to gain unauthorized access to the Service Platforms.
viii. You agree not to do anything to interfere with or impair the intended operation of the Services, including misusing any reporting, dispute, or appeals channel, such as by making fraudulent or groundless reports or appeals.
ix. In any case, the Owner retains the authority to erase, modify, or deny access to any User content that is perceived, in the Owner’s judgment, to be infringing, unlawful, violative of these terms, or detrimental to the Service Platforms or its users. The Owner disclaims any accountability for the nature, accuracy, or legitimacy of any User Content posted on InfoProfile and our Service Platforms.
x. You are advised to exercise prudence and judgment when engaging with such content. In case of non-compliance with obligations or the infringement of applicable laws, the Owner reserves the right to suspend or terminate your access to the Services, in addition to pursuing any legal remedies that might be deemed necessary.
xi. You acknowledge that the Owner bears no obligation to monitor or review User content, and any such actions undertaken by the Owner do not constitute an assumption of liability or responsibility for the said content.
xii. The Owner’s use of your/User Content, as outlined in these terms, shall not entail any obligation to compensate you financially, economically, socially, or otherwise, unless explicitly specified in a separate written agreement between the Owner and you. The aforementioned rights and obligations pertaining to your/User Content survive termination or cessation of your utilization of the Services or the agreement.
xiii. When using InfoProfile, you may encounter content or information that is inaccurate, incomplete, delayed, misleading, illegal, offensive, or otherwise harmful. InfoProfile does not generally review content provided by the Members or others, so you agree that InfoProfile is not responsible for the content or information published by others (including other Members). You understand that We cannot always prevent the misuse of our Services, and you agree that We are not responsible for any such misuse.
xiv. You acknowledge the risk that you or your organization may mistakenly be associated with content about others when we let your connections and followers know that you or your organization were mentioned in the news. Members have choices about this feature.
Our Services enable messaging and sharing of information in many ways, such as your profile, articles, posts, links to news articles, job postings, messages, and content that you share or post may be seen by other Members, Visitors, or others. Where we have made settings available, we will honor the choices you make about who can see content or information (e.g., message content to your addressees, sharing content only with your connections and followers, restricting your profile visibility from search engines, or opting not to notify others about news). We are not obligated to publish any information or content on our Service Platforms and can remove it with or without notice.
i. By becoming a member of InfoProfile, you grant InfoProfile a non-exclusive, worldwide, transferable, and sub-licensable right to use, copy, modify, distribute, publish, and process any information or content that you provide through InfoProfile's Services or the Services of others. This right is granted without any further consent, notice, or compensation to you or others.
ii. InfoProfile reserves all its intellectual property rights in the Services.
iii. InfoProfile logos, graphics, and other service marks are trademarks or registered trademarks of InfoProfile and are subject to copyright. You shall not use InfoProfile’s logos or branding without prior consent.
iv. You may share posts from other professionals' websites, but you must attribute the original source. You may not copy and paste another professional's content and use it as your own.
v. You consent to InfoProfile Network sharing your information on our Service Platforms and social media platforms. You consent to InfoProfile using your images and infographics on our Service Platforms to promote your business. We will ask permission and seek consent for other uses (for example, to illustrate more general posts or media).
vi. All content on the Service Platforms, including but not limited to text, images, videos, and logos, is owned by or licensed to the Owner and is protected by intellectual property laws.
i. We offer two types of Memberships, which are as follows:
▫ No registration fee for using the Services.
▫ Includes access to standard features, such as profile creation, connection with other members, and content sharing.
▫ You agree to pay us the applicable fees and taxes and to additional terms specific to the paid Services.
▫ The subscription fee may be subject to taxes and transaction fees depending on your location and the payment method used.
If you purchase Premium Membership, your payment method will automatically be charged at the start of each subscription period for the recurring subscription fee, either monthly or annually depending on your chosen plan, and taxes applicable to that period.
We may store your payment method (e.g., credit card) even after it has expired, to avoid interruptions in your Services and to use it to pay for other Services you may buy. The automatic payment will occur on the same day each billing cycle, as specified below.
To avoid future charges or to opt out of Services, you must cancel before the renewal date, and your Premium Membership will expire at the end of the current billing cycle. It is your sole responsibility to cancel auto-pay if you wish to discontinue Premium Membership.
All your purchases of Services are subject to InfoProfile’s refund policy (as mentioned further).
You are responsible for ensuring your payment method is valid and has sufficient funds. We accept credit cards, debit cards, and other methods as indicated on the Platform.
We reserve the right to change subscription fees at any time, with advance notice. You can accept the new pricing or cancel your subscription.
Subscription fees may be subject to taxes and transaction fees, which are your responsibility.
While we use encryption for payment security, internet data transmission is not completely secure.
You can get a copy of your invoice through your InfoProfile account settings under “Purchase History.”
If you dispute a payment, contact our customer support team at support@infoprofile.com for resolution.
We may update these terms and conditions, including subscription fees, from time to time. Any changes will be effective upon posting on the Platform, and it is your responsibility to review them periodically.
By subscribing to Premium Membership on the Platform, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined above. If you do not agree to these terms, please do not subscribe to Premium Membership.
i. InfoProfile reserves the right to limit your use of its website, including the number of your connections and your ability to contact other Members. InfoProfile also reserves the right to restrict, suspend, or terminate your account if you breach these terms and conditions or the law, or if you are misusing the Services provided by InfoProfile.
ii. InfoProfile may terminate your account at any time for any reason, including but not limited to:
Breach of these Terms and Conditions.
Engaging in any activity that InfoProfile deems to be illegal, harmful, or offensive.
Failing to pay any fees owed to InfoProfile as and when applicable.
Being inactive on the Website for an extended period, such period of inaction shall not be less than 1 year.
iii. We reserve the right to terminate or suspend your Premium Membership with or without notice if you violate our terms of service/use or engage in any prohibited activities on the Service Platforms.
iv. You may terminate your account at any time by contacting InfoProfile at support@infoprofile.com
v. If your account is terminated, you will no longer be able to access the Website or use the Services. InfoProfile may also delete any content or information that you have posted on the Website.
vi. In the event of termination, you will not be entitled to a refund of any subscription fees paid.
vii. Upon termination of your account, all the provisions of these Terms and Conditions that by their nature should survive termination shall remain in full force and effect.
i. We, Enso Webworks Private Limited company, may, at our sole discretion, offer refunds for Premium Membership subscriptions on a case-by-case basis.
ii. Refund requests will be considered only under exceptional circumstances, and we reserve the right to deny any refund request without issuance of any reason whatsoever.
iii. Refund requests, if any, must be made within (7) Seven days of the initial purchase date. All refund requests should be submitted in writing to our customer support team at support@infoprofile.com, including your name, username, and a detailed explanation of the exceptional circumstances necessitating the refund.
iv. Refunds, if granted, will be issued to the original payment method used for the subscription at our discretion. We may deduct any applicable processing fees, taxes, or transaction costs from the refunded amount.
v. We are not obligated to provide refunds for any subscription fees paid, and no refunds will be offered for reasons including but not limited to dissatisfaction with Premium Membership features or services.
vi. If your Premium Membership is terminated by us due to a violation of our terms of service, you will not be eligible for any refund of subscription fees paid.
InfoProfile and its affiliates make no representations or warranties about the Services, including any representations that the Services will be uninterrupted or error-free. InfoProfile provides the Services (including content and information) on an 'as is' and 'as available' basis. To the extent permitted by applicable law, InfoProfile and its affiliates disclaim any implied or statutory warranties, including any implied warranty of title, accuracy of data, non-infringement, merchantability, or fitness for a particular purpose.
Our Privacy Policy governs the collection, use, and disclosure of your personal information. By using the website, you acknowledge that you have read, understood, and agree to our Privacy Policy.
To the extent permitted by law and unless InfoProfile or the Owner has entered into a separate written agreement that overrides this agreement, InfoProfile and its affiliates will not be liable under this contract for loss of profits, business opportunities, reputation, or data. Owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the website. These limitations of liability are part of the basis of the bargain between you and the Owner and shall apply to all claims of liability (e.g., warranty, tort, negligence, contract, and law) even if InfoProfile or its affiliates have been told of the possibility of any such damage, and even if these remedies fail their essential purpose. These limitations of liability do not apply to liability for death or personal injury or for fraud, gross negligence, or intentional misconduct, or in cases of negligence where a material obligation has been breached, a material obligation being such which forms a prerequisite to our delivery of services and on which you may reasonably rely, but only to the extent that the damages were directly caused by the breach and were foreseeable upon conclusion of this Contract and to the extent that they are typical in the context of this Contract.
In the event any provision of this Agreement is determined to be void, invalid, or unenforceable, such determination shall not affect the remainder of this Agreement, which shall continue to be in force.
InfoProfile’s failure to enforce any provision of these Terms and Conditions will not be considered a waiver of such provision.
This Contract shall be governed by and construed in accordance with the laws of India only, without regard to its conflict of law’s provisions. Any dispute, controversy, or claim arising out of or relating to this contract, or the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with the rules of the Delhi Center for Arbitration. The place of arbitration shall be Delhi, India. The award rendered by the arbitrator(s) shall be final and binding upon the parties.
You hereby undertake an obligation to observe and adhere to the present terms and conditions, as well as any supplementary terms, conditions, and policies referred to within this document or presented on the website.
